Nokia wins German patent suit against HTC - WinFuture

law, politics & EU For the Taiwanese manufacturer HTC, it was not a particularly good year and it goes well with a defeat to an end. A Munich court considered that HTC devices such as the One against a Nokia patent infringed.

The legal battle between Nokia and HTC was terminated in favor of the Finnish manufacturer’s yesterday. At the Munich District Court Judge Matthias Zigann spoke of a Germany-wide and permanent injunction against a range of HTC models like the blog FOSS Patents reported.

In concrete terms, in the already one and a half years of litigation by the European patent number EP1148681, which is part of Nokia. This describes a “method for the transmission of source information” (as a URL) by two users connect their mobile devices via NFC or Bluetooth (but no Wi-Fi or Internet).

HTC can appeal against the decision Insert. Should the Taiwanese company, the court not immediately clear and convincing be taken that the appeal has big chance of success, then Nokia has the ability to enforce against have to leave a security in the amount of 400 million euros the injunction. This also means that Nokia may require that the HTC models that infringe the patent, takes from the market.

The security payment from Nokia is for the purpose of any award of damages by HTC, this gives the manufacturers from Asia entitled, you should be able to prevail on appeal against Nokia. Whether it actually comes to a ban on the sale, it is currently unclear. HTC can remove the standing associated with the patent function or (financially) some with Nokia in this regard.

Since the patent would also have consequences for all other Android manufacturers, currently also initiatives from HTC and Google run itself, it invalidated can be explained. However, for the decision of the District Court which came too late and could not be considered.
